El presente estudio analiza cómo la Empresa de Transmisión Eléctrica Dominicana
(ETED) desarrolla el proceso de negociación para otorgar las indemnizaciones por servidumbre
de paso de líneas de transmisión eléctrica. La metodología utilizada condujo a la identificación,
análisis y selección de las leyes que regulan las empresas del sector eléctrico nacional, así como
las normativas internas de la empresa objeto de estudio. Para la recogida de datos se aplicó un
cuestionario al personal de alta gerencia y mandos medios de la ETED. Los instrumentos de
recopilación de información se aplicaron durante dos meses durante los cuales se revisaron los
archivos de la empresa ETED para establecer los criterios utilizados para indemnizar los
propietarios de los predios, por la servidumbre de transmisión eléctrica, en 155 municipios
ubicados a nivel nacional. Los resultados revelan la necesidad de revisar los procesos de
indemnización para la gestión de proyectos eléctricos, lo que conllevó la presentación de una
propuesta metodológica para el cálculo de indemnizaciones justas y equitativas para los
afectados por la constitución de servidumbres. Se recomienda capacitar continuamente y dar
mayor participación a los agentes fiscalizadores en los procesos de indemnización a las personas
afectadas.
This study analyzes how the Dominican Electricity Transmission Company (ETED)
develops the negotiation process to grant compensation for the easement of the passage of
electric transmission lines. The methodology used led to the identification, analysis and
selection of the laws that regulate the companies of the national electricity sector, as well as the
internal regulations of the company under study. For the collection of data, a questionnaire was
applied to the senior management and middle managers of the ETED. The information
collection instruments were applied for two months during which the archives of the ETED
company were reviewed to establish the criteria used to compensate the owners of the
properties, for the servitude of electric transmission, in 155 municipalities located nationwide.
The results reveal the need to review the compensation processes for the management of
electrical projects, which led to the presentation of a methodological proposal for the calculation
of fair and equitable compensation for those affected by the constitution of easements. It is
recommended to continually train and give greater participation to the supervisory agents in the
