Facultad reglamentaria del Presidente de la República
Abstract
Se analiza el sistema político dominicano en estos momentos se aprecia que atraviesa por una seria crisis de representatividad y gobernabilidad que empieza a comprometer el consenso y la legitimidad en que debe sustentarse. Se abordan algunas modificaciones a la Constitución que pueden resultar favorables al fortalecimiento del proceso democrático como: es la integración en grupos que deben ir acompañado de una renovación profunda de los elementos, valores y actitudes de las clases dirigentes nacionales, en especial, de la clase política. Se enfatiza que la reforma que se practique debe tener una buena dosis de ponderación y sentido realista procurar una fórmula que concilie estos requerimientos representatividad, control y eficacia del poder. Se establecen las diferencias y similitudes entre la ley y el reglamento. Se reflexiona sobre el predominio del ejecutivo en el orden jurídico se ha reflejado un incremento extraordinario de las reglas de derecho elaboradas por el Poder Ejecutivo a través de los reglamentos, ordenanzas o decretos-leyes. Un aspecto importante a tener en cuenta a los fines de supervigilar el uso del poder reglamentario por parte del Presidente de la República como anular en general preceptos normativos contrarios a la Constitución de la Republica. Se afirma que si la Reforma Constitucional consigue que el Congreso Nacional,· el Poder Judicial, ·la Cámara de Cuentas, el Contralor General de la República,· la Junta Central Electoral, los Partidos Políticos, el Tribunal Superior Administrativo y la Administración Pública resulten consolidadas, habrían menos motives para temer que el Presidente de la República con su poder reglamentario sea factor de perturbación o ruina del orden democrático.
